TERMS & CONDITIONS

You can find our full Terms and Conditions below, but the key points are as follows:
 

  1. Returns are not accepted for decorated tiles. Returns of surplus plain tiles may be considered at our discretion, provided they are in good condition.

  2. White Cobalt White is not liable for shortages, non-compliance with the Buyer’s specifications, or defects in the Goods unless a written claim is submitted within three days of receipt. Returns will only be processed if the Goods can be inspected by the Seller.

  3. Any damages or breakages must be reported in writing within three days of delivery.

  4. As all our tiles are handmade, slight variations in size, thickness, and colour are to be expected. Samples provided are indicative only and may not perfectly match the final product.

  5. Orders will only proceed once written confirmation and a 50% deposit have been received.

  6. Once notified that your order is complete, full payment must be made before delivery is arranged. Payment must be received within five working days to avoid incurring a weekly storage fee. Tiles will be dispatched upon full payment.

  7. Lead times are approximate. Should there be any delays, you will be informed as soon as possible.

White Cobalt White is dedicated to safeguarding customer data and only collects personal information necessary to provide our services. By providing us with this information, you confirm that you have the authority or consent to share it with us. We ensure that:
 

  • The data is used solely for the purpose it was provided.

  • It is securely stored and retained only as long as necessary to deliver our services.

  • It will not be shared with third parties except when required for the delivery of Goods.

  • It remains accessible, correctable, and removable upon request during the retention period.

White Cobalt White – Terms and Conditions of Supply

  1. Definitions
    1.1 Buyer: Refers to the person or entity that accepts the Seller’s written quotation.
    1.2 Goods: Refers to the items, including any installments or parts of them, supplied by the Seller under these terms. This also includes installment-related costs not directly tied to the supply of the Goods.
    1.3 Seller: Refers to White Cobalt White.

  2. Sales
    2.1 The Seller agrees to sell, and the Buyer may purchase, the Goods in accordance with any written quotation provided by the Seller and accepted by the Buyer, or any written order from the Buyer that is accepted by the Seller. These terms govern such transactions.
    2.2 No modifications to these terms are valid unless confirmed in writing by authorised representatives of both the Buyer and the Seller.
    2.3 Any statements regarding the Goods made by the Seller’s employees or agents are not binding unless confirmed in writing by the Seller.
    2.4 Any advice provided by the Seller regarding the installation, storage, or maintenance of the Goods that is not confirmed in writing is followed at the Buyer’s own risk. The Seller accepts no liability for such informal advice.
    2.5 Any arrangements for installation work related to the Goods must be made directly between the Buyer and the installer. The terms of such installation work are governed by the installer’s terms and conditions.
    2.6 Any typographical, clerical, or other errors in the Seller’s sales literature, quotations, price lists, or other documentation may be corrected without liability to the Seller.

  3. Orders and Specifications
    3.1 The Seller must confirm any order submitted by the Buyer in writing for it to be considered accepted.
    3.2 The specifications, including quantity, quality, and description of the Goods, shall align with the Seller’s quotation (if accepted by the Buyer) or the Buyer’s order (if accepted by the Seller).
    3.3 Due to the handmade nature of our tiles, variations in size, thickness, and colour are to be expected. Samples provided are indicative and may not perfectly match the final product.

  4. Pricing
    4.1 The price of the Goods will be either the quoted price or, if no quote is provided or the quote has expired, the price listed in the Seller’s current price list at the time of the order’s acceptance. Quotes are valid for 28 days.
    4.2 The Seller reserves the right to adjust prices before delivery if there are cost increases outside its control, such as currency fluctuations. Changes to delivery dates, specifications, or order details requested by the Buyer may also impact pricing.
    4.3 Prices are exclusive of VAT, which will be added and payable by the Buyer.

  5. Payment Terms
    5.1 Unless otherwise agreed in writing, 50% of the purchase price is payable upon acceptance of the Seller’s quotation, with the remaining balance due before delivery. Orders cannot be guaranteed without the initial payment.
    5.2 If the Buyer fails to make payment on time, the Seller reserves the right to cancel the contract or suspend deliveries.
    5.3 In the event of non-payment, the Seller may:

    • Cancel the contract and halt further deliveries.

    • Allocate any payments received from the Buyer toward specific Goods.

    • Charge interest on overdue amounts at 12% APR until payment is received.

  6. Delivery
    6.1 If the Buyer fails to accept delivery or provide sufficient delivery instructions (unless due to circumstances beyond their control), the Seller may:

    • Store the Goods and charge the Buyer for storage costs, including insurance.

    • Sell the Goods and either credit the Buyer for any amount exceeding the contract price or charge for any shortfall.

    • Charge the Buyer for costs incurred from failed delivery attempts, plus VAT, with interest applied at 12% per annum until paid.
      6.2 Delivery dates provided are estimates and not guaranteed.

  7. Risk and Ownership
    7.1 Risk of loss or damage to the Goods passes to the Buyer upon delivery or when the Buyer wrongfully fails to take delivery.
    7.2 Ownership of the Goods transfers to the Buyer once full payment, including VAT, has been received by the Seller.

  8. Warranties and Liability
    8.1 The Seller is not liable for shortages, defects, or failure to meet specifications unless a written claim is made within three days of delivery. Returns will only be accepted if the Seller has had the opportunity to inspect the Goods.
    8.2 The Seller’s liability is limited to addressing shortages, defects, or failures. The Seller is not responsible for indirect or consequential losses arising from such issues.

  9. Force Majeure
    The Seller is not liable for failure to fulfill its obligations due to circumstances beyond its control, such as accidents, equipment failure, war, pandemics, riots, industrial action, or acts of terrorism.

  10. General
     If any provision of these terms is deemed invalid or unenforceable, the remaining provisions remain unaffected.
    These terms are governed by the laws of Portugal.
